On April 6, 2010, Judge Steven A. Brick granted preliminary approval of a proposed settlement in the action entitled The Pennsylvania Avenue Funds v. Avigen, Inc., et al., Case No. RG09470224, pending in the Superior Court of California for Alameda County (the "Settlement"). The Settlement pertains to you if you held shares of Avigen common stock at some time from August 20, 2009 through and including December 18, 2009.
