On November 7, 2014, the United States District Court for the Central District of California preliminarily approved a proposed settlement in the case titled, Lima v. Gateway, Inc. The proposed Settlement provides a cash payment of $195 to each original purchaser of a Gateway 30" XHD 3000 LCD Monitor who submits a valid claim form. This action arose from allegations that Gateway, Inc. promoted the XHD 3000 as having superior quality and high functioning capability, yet it failed to perform as advertised, thus allegedly violating the CLRA, UCL, and FAL. The action, managed by Finkelstein Thompson LLP Partner Rosemary M. Rivas, provides significant cash payments to class members who submit valid claims. The certified class consists of, "All persons or entities in the United States who are original purchasers of a Gateway 30" XHD 3000 LCD Monitor." Class members have until May 21, 2015 to submit their claim. A fairness hearing will be held on February 27, 2015 at 9:30 a.m. before the Honorable Dolly M. Gee.
