On August 18, 2008, Finkelstein Thompson LLP filed a lawsuit seeking class action status against Countrywide Financial Corporation ("Countrywide"), a California-based company. The complaint, filed in the United States District Court for the Central District of California, alleges that Countrywide failed to maintain reasonable and adequate security procedures to protect against the theft of Countrywide customers’ and mortgage applicants' sensitive personal information. The complaint further alleges that as many as 2 million Countrywide customers and mortgage applicants may have had their sensitive personal and financial information, including social security numbers, stolen by a Countrywide employee and sold to unknown entities. CASE STATUS UPDATE [November 2009]: A settlement has been reached in an action against Countrywide for violations of applicable state common laws and consumer protection laws. On January 21, 2009, Finkelstein Thompson LLP filed a motion as putative co-lead counsel with the Court, along with additional plaintiffs' counsel, for Preliminary Approval of Class Action Settlement and Publishing of Notice, and Setting of a Final Fairness Hearing. This matter remains pending before the Court.
CASE STATUS UPDATE [January 2010]: On December 22, 2009 the Court issued an Order granting Preliminary Approval of Class Action Settlement and Publishing of Notice and scheduling the Final Fairness Hearing for July 19, 2010. Notice of the Settlement will be sent to members of the Class along with instructions on how to submit their claims.
