Finkelstein Thompson LLP Investigates Tricare Data Breach.

Finkelstein Thompson LLP has filed a lawsuit seeking class action status against TRICARE Management Activity ("TMA"), the agency administering the TRICARE health care program to Uniformed Service members, retirees and their families; Science Applications International Corporation ("SAIC"), the government contractor for TMA; the United States Department of Defense ("DOD"); and Leon Panetta, in his Official Capacity as Secretary of the DOD, (collectively, "Defendants"). The complaint, filed in the United States District Court for the District of Columbia, alleges that Defendants failed to maintain reasonable and adequate security procedures to safeguard its millions of military clinic and hospital patients' personally identifiable and protected health information.  Such confidential information includes members’ Social Security numbers, addresses, phone numbers, and some personal health data such as clinical notes, laboratory tests, and prescription information. The complaint further alleges that as many as 4.9 million of TRICARE members may have had their confidential information compromised when the members'; confidential information was contained on improperly encrypted or unencrypted backup tapes and stolen from an SAIC employee's vehicle on September 14, 2011.
