Finkelstein Thompson LLP has filed a class action suit against Ticketmaster Entertainment, Inc. (“Ticketmaster”) and TicketsNow.com, Inc. (“Ticketsnow”). The complaint, filed on March 23, 2009 alleges that until at least February 23, 2009 potential ticket purchasers searching for tickets on Ticketmaster.com at face value were systematically redirected to TicketsNow.com. TicketsNow, a ticket resale website owned by Ticketmaster, offers tickets at prices exceeding face value. This practice was not adequately disclosed. And in some instances, this occurred even when seats remained available at Ticketmaster. Many consumers were unaware that they were purchasing tickets that were being resold. This practice became publicly known starting on February 2, 2008. On that date, Bruce Springsteen tickets became available on Ticketmaster’s website, but when fans endured technical problems or were informed that the event was “sold out,” they were redirected to the TicketsNow website, where tickets were available at a greatly inflated price. Ticketmaster’s sales practices have been investigated by several authorities following similar incidents involving sales for Bruce Springsteen, and Miley Cyrus, a.k.a. Hannah Montana. Fans of acts such as Phish, The Dead, and others have also complained that when they attempted to purchase regular-priced tickets they were directed to the TicketsNow website even when regularly priced tickets were still available.
