| Mercedes-Benz Tele Aid System Consumer Fraud Class Action |

On November 16, 2007, Finkelstein Thompson LLP filed lawsuits in the United States District Court for the Central District of California and the Northern District of Illinois against Mercedes-Benz USA, LLC ("MBUSA"). The lawsuits, which seek class action status, were filed on behalf of persons who purchased or leased Mercedes-Benz vehicles equipped with analog Tele Aid systems. The complaints allege that MBUSA illegally marketed and sold automobiles equipped with analog Tele Aid systems without disclosing to buyers that the Federal Communications Commission announced that it would no longer require cellular operators to support analog networks after February 18, 2008, a date after which all analog Tele Aid devices will be unable to communicate to safety call centers. Purchasers now face a shutdown of their analog safety system and may have little or no remedy. Those who are eligible for upgrades to a digital Tele Aid model may be deterred by the cost of upgrade and/or requests to sign extended service subscriptions before the upgrade work is performed.
