On November 13, 2007, Finkelstein Thompson LLP filed a lawsuit seeking class action status against Gap, Inc ("Gap" or the "Company".) The complaint, filed in the United States District Court for the Northern District of California, alleges that the Company failed to maintain reasonable and adequate security procedures to protect against the theft of job applicants' personal information. In September 2007, Gap, Inc. announced that two laptops containing names, social security numbers, addresses and other personal information for approximately 800,000 job applicants had been stolen from a third-party recruiting vendor. According to Gap, the vendor was responsible for maintaining applicants' personal information and, contrary to their service agreement, that information was not encrypted. Applicants who applied to Gap Inc.'s Old Navy, Gap, Banana Republic and Outlet stores between July 2006 and June 2007 were affected by this incident and have reportedly been contacted by the company.
