The Defendants have appealed the class certification decision to the Second Circuit Court of Appeals, and the trial has been stayed pending the outcome of that appeal.  Oral arguments on the Appeal were heard by the Second Circuit on July 10, 2007, and we are currently awaiting a decision on this matter.  If the Class Certification decision is upheld by the Second Circuit then the lower court judge will set a trial date.
