Finkelstein Thompson LLP is investigating Toshiba's marketing and sale of HD DVD players. In 2002, Toshiba introduced the High Definition DVD ("HD DVD") format, which it billed as the "next generation" of the standard DVD format offering true high-resolution video. Toshiba's HD DVD format competed with Sony's Blu-ray, another DVD format also offering high-resolution video. In March 2006, Toshiba introduced its first consumer-based HD DVD player. Given the competition between the HD DVD and Blu-ray formats, the successful sale and marketing of Toshiba's HD DVD players depended on the longevity of the HD DVD format. Thus, in marketing and selling its HD DVD players, Toshiba represented that the HD DVD format was for "Today, Tomorrow and Beyond." On February 19, 2008, Toshiba announced its plans to terminate the development, manufacture, and marketing of its HD DVD players, essentially "killing" the HD DVD format. It is reported, however, that until this time, Toshiba continued to market and sell its HD DVD players, without disclosing this material information to consumers.
