Finkelstein Thompson LLP is investigating allegations that title insurance companies overcharged homeowners who refinance by purposefully failing to mention to the homeowner that they qualify for a discounted premium. Homeowners may be eligible for a 10 percent "reissue rate" discount whenever they purchase title insurance within 10 years of obtaining a policy issued on the same property. Homeowners are supposed to receive a 20 percent "refinance rate" discount if they apply for title insurance within three years of obtaining a previous policy. However, it is believed that certain title agents failed to apply the appropriate discount even though they conducted a title search and discovered that an insurance purchaser had refinanced the property within the past three or 10 years.
