Finkelstein Thompson LLP has filed a class action suit against Heartland Payment Systems (“Heartland”) for a data breach. On January 22, 2009, Heartland announced that the consumers’ financial information that it handles was stolen. Consumers may have had their sensitive personal, including names, credit card and debit card numbers, and expiration dates, stolen by unknown entities.

The breach occurred sometime in 2008 when software was installed on Heartland’s network. The software enabled the thieves to “grab transactions” as they occurred on Heartland’s systems. Heartland was alerted to the suspicious activity surrounding processed card transactions by Visa and Mastercard.
