Finkelstein Thompson LLP Investigates The Flushmate III Pressure-Assisted Flushing System PDF Print E-mail

Recently the U.S. Consumer Product Safety Commission ("CPSC") announced a voluntary recall of the Flushmate III Pressure-Assisted Flushing System ("Flushmate III"). The Flushmate III presents a hazard of bursting at or near the vessel weld seam with a force strong enough to shatter the tank. The CPSC has already received 304 reports of the product bursting, resulting in property damage  and 14 impact or laceration injuries.

While the manufacturer is providing a free repair kit, Finkelstein Thompson LLP is investigating reports that the repair kit is inadequate. In particular, the firm is investigating allegations that the repair compromises the flushing action and is an inadequate repair.

The Flushmate III was sold at Home Depot, Lowes, and to toilet manufacturers including American Standard, Crane, Eljer, Gerber, Kohler, Mansfield and St. Thomas.
