DVD Rentals Investigation
January 21, 2009

Finkelstein Thompson LLP is investigating allegations that Netflix, Inc. (“Netflix”) may have wrongfully charged too much for online DVD rentals.

If you are either a Netflix or Blockbuster Online (“Blockbuster”) DVD rental customer, you may be a victim of this practice.

Recently-filed class action complaints allege that, on or about May 19, 2005, Netflix, Wal-Mart Stores, Inc. (“Wal-Mart Stores”), and Walmart.com USA LLC (“Walmart.com”) agreed to stop competing in markets for the sale and online rentals of DVDs in the United States.  These complaints further allege that Netflix was able to avoid price competition as a result of that agreement.  Such an agreement could violate the federal antitrust laws, entitling Netflix and Blockbuster customers to legal remedies.  The complaints do not allege any allegations concerning wrongdoing by Blockbuster.
